How to Get a Medical Marijuana Card in Texas: Texans with certain medical conditions may qualify to get a medical marijuana card in Texas. Eligible Texans will have access to medical marijuana through the State’s Compassionate Use Program (CUP) administered by the Texas Department of Public Safety (DPS).

In 2015, the Texas Compassionate Use Act was enacted by the Texas Legislature. The bill required the Texas Department of Public Safety to create a secure registry of physicians who treat epilepsy, seizure disorders, multiple sclerosis, Post-traumatic Stress Disorder (PTSD), and other qualifying diseases.

DPS administers the Compassionate Use Program in Texas, under the authority of the Texas Health and Safety Code, Chapter 487. Through the CUP program, DPS creates a secure online registry of qualified physicians who can prescribe low tetrahydrocannabinol (THC) to patients with specific qualifying medical conditions.

The registry called the Compassionate Use Registry of Texas (CURT), is designed to ensure that only one qualified physician registers as the prescriber for a single patient. The CURT is accessible to law enforcement agencies and dispensing organizations to verify patients with low-THC cannabis. It also allows physicians to input safety and efficacy data generated from the treatment of patients that low-THC cannabis was prescribed.

DPS manages the licensing of organizations that dispense low-THC cannabis to patients in the CURT.

Low-THC cannabis is cannabis and its derivatives that contain no more than 0.5% of THC by weight.

A patient may get Low-THC cannabis prescribed if:

  • The patient must be a permanent resident of Texas
  • The patient has one of the qualifying medical conditions
  • A CUP registered physician prescribes the low-THC cannabis
  • The qualified physician decides the benefit of taking the Low-THC cannabis outweighs the risk

There is no age limit for prescriptions for qualified patients. However, patients under 18 may need a legal guardian or parent to register as their caregiver.

Getting a prescription: 

The licensed medical marijuana doctor will enter a prescription in the Compassionate Use Registry of Texas (CURT).

Afterward, the patient or legal guardian can visit any licensed dispensary to get the prescription.

The patient or legal guardian will need to provide the patient’s ID and information such as the patient’s last name, date of birth, and last five digits of their Social Security Number.

Licensed dispensaries use the CURT system to search for the patient’s information before filling or giving out any related prescriptions.

  • Seizure disorder
  • Spasticity

Medical Documentation needed

If you have a qualifying medical condition and you also have medical documentation such as medical records, pill bottles, office visit summaries, or a letter from your doctor stating your diagnosis, then you’re ready to be seen by a licensed marijuana doctor to get certified.

If you have a qualifying medical condition but don’t have medical documentation, book an appointment with your doctor so that he/she can diagnose your condition and refer you to a licensed medical marijuana doctor for evaluation and certification.

The marijuana doctor will review your medical history and any other documentation that you are able to provide as proof. If the doctor is satisfied, you will be approved and entered into the Compassionate Use Registry of Texas (CURT)
